Welcome to Zarbo Ceramics (“we,” “us,” “our,” “I,” or “me”). By accessing or using my website (the “Site”), you agree to be bound by these Terms of Service(“Terms”). If you do not agree with these Terms, do not use our site.

Our store is hosted on Squarespace. They provide me with the online e-commerce platform that allows me to sell my products and services to you.

1. Use of the Site

• Eligibility: You must be at least 18 years old to use this Site. By using the Site, you confirm that you meet this requirement.

• Permitted Use: The Site is for personal, non-commercial use unless otherwise agreed in writing. You may not use the Site for any unlawful purpose or in a way that violates these Terms.

• Account Responsibility: If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account. Notify me immediately of any unauthorized use.

2. Products and Purchases

• Product Descriptions: I strive to ensure that all product descriptions, images, and prices on the Site are accurate. However, minor variations in color, shape, or size may occur due to the handmade nature of my pottery.

• Pricing: All prices are listed in USD and exclude taxes or shipping unless stated otherwise. I reserve the right to change prices without notice, but the price at checkout will apply to your order.

• Payment: WI accept payments via credit/debit cards, PayPal, Apple Pay. By providing payment information, you confirm that you are authorized to use it.

• Order Confirmation: Orders are subject to acceptance. I may cancel or refuse orders due to stock issues, pricing errors, or suspected fraud, with a full refund issued if applicable.

3. Shipping and Delivery

• Shipping Policy: I ship within the United States of America. Shipping costs and estimated delivery times are provided at checkout. I am not responsible for delays caused by carriers or customs.

• Risk of Loss: Ownership and risk of loss transfer to you upon delivery to the shipping carrier.

• Damaged Goods: If an item arrives damaged, please contact us within 48 hours with photos at ZarboCeramics@gmail.com. We’ll arrange a replacement or refund, subject to our discretion.

4. Returns and Refunds

• Return Policy: Orders are non-returnable unless defective. See my Returns Policy for details.

• Refunds: Approved refunds will be processed within 7-10 business days to the original payment method. Shipping costs are non-refundable unless the item is defective.

• Exclusions: I do not accept returns for items damaged due to misuse or failure to follow care instructions.

5. Intellectual Property

• Ownership: All content on the Site, including images, designs, logos, and text, is owned by Zarbo Ceramics.

• Limited Use: You may not reproduce, distribute, or create derivative works from our content without written permission, except for personal, non-commercial use.

• Custom Designs: Custom orders remain our intellectual property unless otherwise agreed in writing.

6. User Conduct

You agree not to:

• Use the Site to transmit harmful, offensive, or illegal content.

• Attempt to access or interfere with our systems or servers.

• Misrepresent your identity or engage in fraudulent activity. We reserve the right to suspend or terminate your access for violations.

• As-Is Basis: Our products and Site are provided “as is” without warranties beyond those required by law. We do not guarantee that the Site will be error-free or uninterrupted.

• Liability Cap: To the fullest extent permitted by law, our liability for any claim arising from these Terms or your use of the Site is limited to the amount you paid for the relevant product.

• No Indirect Damages: We are not liable for indirect, incidental, or consequential damages, such as loss of profits or data, arising from your use of the Site or products.

• Governing Law: These Terms are governed by the laws of Florida, USA, without regard to conflict of law principles.

• Dispute Resolution: Any disputes arising from these Terms will be resolved in the courts of Santa Rosa County, Florida, United States of America. You agree to submit to their jurisdiction.

We may update these Terms at any time by posting the revised version on the Site. Changes take effect immediately, and your continued use of the Site constitutes acceptance.
